1. Services and Scope of Work
GrowthWebHub provides digital agency services customized to client requirements as outlined in project proposals, scopes of work (SOW), or service agreements.
Any additions, revisions, or feature requests outside the agreed project scope will incur additional charges and timeline adjustments.
2. Intellectual Property Rights
Agency Ownership: All materials on our website—including logos, branding, text, graphics, and code—are the intellectual property of GrowthWebHub and are protected by applicable copyright and trademark laws.
Client Deliverables: Upon full and final payment of all project fees, ownership of custom designs, website code, and approved branding assets created specifically for the client will be transferred to the client.
Portfolio Usage: Unless explicitly agreed upon in writing through a Non-Disclosure Agreement (NDA), GrowthWebHub retains the right to display completed client projects in our portfolio, website, case studies, and marketing materials.
3. Payment Terms and Project Execution
Advance Payments: All web development, design, and marketing projects require an advance deposit before work commences, as specified in your agreement.
Milestone Payments: Project payments must be cleared according to the agreed milestone schedule. Final website deployment or source file delivery will occur only after final payment clearance.
Retainers: Monthly retainerships for SEO, Meta Ads management, or social media management are payable in advance at the start of each billing cycle.
4. Client Responsibilities
To ensure timely project delivery, clients are required to:
Provide all necessary content, images, brand assets, credentials, and approvals in a timely manner.
Delays caused by late client feedback or missing materials will result in corresponding project timeline extensions.
5. Digital Marketing and SEO Disclaimer
While GrowthWebHub utilizes industry-leading strategies and best practices for Search Engine Optimization (SEO), Pay-Per-Click (PPC), and Social Media Marketing:
We do not guarantee specific search engine rank placements, fixed sales volume, or exact Return on Ad Spend (ROAS).
Search engine algorithms, platform policies (Google, Meta), market competition, and ad auction dynamics are beyond our direct control.
6. Limitation of Liability
In no event shall GrowthWebHub, its directors, employees, or partners be liable for any indirect, incidental, consequential, or business loss (including loss of revenue, data, or profit) arising from the use of our website, service delays, server downtime, or third-party platform policy changes.
7. Termination of Services
Either party may terminate a project or recurring service agreement by providing written notice as specified in the service agreement (typically 15 to 30 days prior notice).
GrowthWebHub reserves the right to suspend or terminate services immediately if payment defaults or terms violations occur.
8. Governing Law and Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts in Delhi NCR, India.
